These Terms cover finallap.com, the notification list, your FinalLap account, and FinalLap Text Alerts, our text message program. The site is run by FinalLap, LLC.
FinalLap has not opened for bidding yet. These Terms describe the service as it will operate, and each part takes effect as that part of the site opens — section 1 says what is running today.
Using the site, joining the notification list, holding an account, or joining the text program means you accept these Terms and our Privacy Policy.
1. About FinalLap
FinalLap is an online auction for collector cars. Lots run on a weekly schedule, with the auction going live on Friday.
Bidding is not open yet. Today finallap.com is a page about the auction and a form for joining the notification list. What the homepage describes is what we intend to build; it may change, and we do not promise FinalLap will launch.
Until bidding opens there is nothing for sale here. Nothing on this site is an offer to sell a car or an invitation to bid, and talking to us about selling or partnering does not commit either of us to anything.
These Terms cover three things: using the site, holding an account, and receiving our text messages. They are not the auction rules. The auction rules — how a bid binds you, what the fees are, when payment is due, and how title moves — are a separate agreement that we present and ask you to accept before you can bid, and it is what governs buying and selling.
2. The List and Accounts
The notification list is phone numbers, and emails where people gave one, belonging to people who want to know when the first auction goes live. Joining it is not an account, a bid, a deposit, or a commitment, and it guarantees you nothing — not an invitation, not early access, not the right to bid.
Accounts are not open yet. When they are, an account will need accurate information and you will be responsible for what happens under it. Keep your login to yourself, and tell us at team@finallap.com if you think someone else has it.
You can give us a mobile number without opening an account, to receive alerts only. Either way, you must be 18 or older and the number has to be a US mobile number you control.
We may limit or close the list and remove any entry, and once accounts exist we may limit, suspend, or close one.
3. FinalLap Text Alerts
FinalLap Text Alerts is our text message program, run by FinalLap, LLC. You opt in on the homepage at finallap.com: you enter your mobile number under a line saying that signing up means agreeing to receive our automated texts, and submitting the form is that agreement. We then text you a one-time code, and you join the list only once you enter that code back into the form. Nothing else on the site opts you in.
We also publish a reference copy of the sign-up at finallap.com/launch/opt-in, which shows the same consent wording and the full disclosures on one screen. It is there to be read rather than to enrol anyone: submitting it stores nothing and sends nothing, and the homepage form above is the only way onto the list.
By opting in you agree to receive automated text messages from FinalLap at that number. Consent is not a condition of buying anything, selling anything, or taking part in an auction.
What we send today: the one-time code that confirms your number, and an alert when the first auction is scheduled and when it goes live.
As each part of the site opens, the same list receives two further kinds of message. Account updates: bid confirmations, outbid notices, reserve met, payment and title status, and changes to your security or profile settings. Auction alerts: when the Friday auction goes live, and when a lot you are watching is about to run. We do not send third-party marketing, and we do not send anyone else's offers.
Message frequency varies. Expect roughly 2 messages a month, and more once you are bidding actively or making frequent changes to your account.
Message and data rates may apply, depending on your mobile plan. FinalLap does not charge for the messages themselves.
You must be 18 or older, and the number must be a US mobile number you control.
Your mobile number and your opt-in are handled as our Privacy Policy describes. We do not share them with anyone for marketing.
4. Stopping the Texts and Getting Help
Reply STOP to any message to stop receiving them. We send one message confirming you have been unsubscribed, and nothing after that unless you opt in again. Reply START to opt back in.
Reply HELP to any message for help, or email team@finallap.com. Email us there to come off the list entirely.
Delivery is not guaranteed. Carriers are not liable for delayed or undelivered messages.
The program works on the major US mobile carriers, and carrier support can change without notice.
If you change or give up your mobile number, tell us at team@finallap.com so we do not text whoever gets it next.
5. Using the Site
Do not misuse it: no submitting numbers that are not yours, no bulk or automated signups, no scraping, nothing illegal. We may block an address, a number, or a network at any time.
The text, design, photography, and any listings here are ours or our sellers', and FinalLap™ is a trademark of FinalLap, LLC. Read the site and link to it freely; anything else needs our permission.
6. Disclaimers and Liability
The site is provided as is, with no warranties of any kind. We do not promise that FinalLap will launch.
We do not promise that any text message will arrive, or arrive on time. Notifications are a convenience, not a guarantee — once bidding is open, watch the auction itself rather than relying on a text.
We are not liable for indirect or consequential damages. Where the law does not allow that, this applies only as far as it can.
7. Disputes
Email team@finallap.com first and give us 30 days. If that does not settle it, you and FinalLap agree to use individual arbitration under the American Arbitration Association's consumer rules rather than going to court, and neither of us will bring a class action. Small-claims court stays open to both of us.
To opt out of this section, email us within 30 days of joining the list, opening an account, or joining the text program. It costs nothing and changes nothing else.
8. Changes, Governing Law, and Contact
We may update these Terms. The new version goes up here with a new effective date, and continuing to use the site or stay on the text list after that means you accept it.
Delaware law applies, and Delaware courts hear anything that does not go to arbitration.
